StorySpan Terms of Service

1. Agreement to Terms
These Terms of Service (the “Terms”) constitute a legally binding agreement between you (“you” or “User”) and StorySpan Inc., a Canadian corporation (“StorySpan,” “we,” “our,” or “us”), governing your access to and use of our website (the “Site”), our digital storytelling platform (the “Platform”), and any other services we provide (collectively, the “Services”). By accessing or using the Services in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not access or use the Services.
2. Eligibility and Authority
The Services are intended for individuals aged sixteen (16) and older. By accessing the Services, you represent and warrant that you are at least sixteen years of age and possess the legal authority to enter into these Terms. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization, and all references to “you” apply to that entity.
3. Description of Services
StorySpan provides a digital storytelling platform where users may capture, store, and share personal stories in audio, video, text, or other formats. At launch, our Services include a one-time purchase product known as “Your Story.” The scope of Services may expand or change over time at StorySpan’s discretion.
4. Account Registration and Responsibilities
To use certain features, you may be required to create an account. You agree to provide accurate, complete, and up-to-date information during registration. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify StorySpan immediately of any unauthorized access or use. StorySpan is not liable for loss or damage resulting from failure to comply with these obligations.
5. Payments and Billing
StorySpan charges fees for certain products and services, including the “Your Story” product. Payment processing is handled by third-party provider Stripe, and your use of payment methods is subject to their terms and privacy policy. All purchases are final and non-refundable, except as required by law or otherwise stated by StorySpan. Promotional codes may be applied at checkout and are governed by applicable promotional terms.
6. Content Ownership and Licenses
You retain ownership of all content you upload, submit, or generate through the Services, including audio, video, images, text, or metadata (“User Content”). By using the Services, you grant StorySpan a worldwide, royalty-free, non-exclusive, sublicensable license to host, store, reproduce, process, adapt, modify, publish, transmit, and display User Content for the purpose of providing and improving the Services.
You grant StorySpan and its authorized personnel the right to access and review recordings solely for technical debugging, quality assurance, monitoring AI-interviewer behavior, and improving the Services. Unless you opt out, you also grant StorySpan the right to use your User Content, in de-identified or anonymized form, for AI model training, marketing, or analytics purposes. Users may opt out of AI training by contacting hello@storyspan.com or through account settings (if available).
7. Storage, Retention, and Deletion
StorySpan uses commercially reasonable efforts to store User Content securely through third-party infrastructure providers such as Amazon Web Services and Google Workspace (Drive). We do not guarantee permanent retention or access. You may request deletion of your account and content by contacting hello@storyspan.com. We will process such requests within 60 days. Backup copies may be retained for at least 90 days and longer where required by law or for legitimate operational purposes.
8. Prohibited Conduct
You agree not to:
• Use the Services in any unlawful, abusive, or fraudulent manner;
• Upload content that is defamatory, infringing, obscene, or hateful;
• Impersonate another person or misrepresent your affiliation;
• Interfere with or disrupt the integrity or performance of the Services;
• Attempt to reverse-engineer or gain unauthorized access to any part of the Services.
9. Disclaimers
The Services and all associated content are provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. StorySpan does not guarantee that the Services will be uninterrupted, secure, or error-free.
10. Limitation of Liability
To the maximum extent permitted by law, StorySpan’s total liability to you for any claim arising from or relating to these Terms shall not exceed the amount you paid to StorySpan in the twelve (12) months preceding the event giving rise to the claim. In no event shall StorySpan be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Services.
11. Indemnification
You agree to indemnify and hold harmless StorySpan Inc., its officers, directors, employees, contractors, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Services, violation of these Terms, or infringement of any rights of a third party.
12. Termination
StorySpan may suspend or terminate your account or access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms or engaged in conduct harmful to other users or to StorySpan.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of Canada and the Province of Manitoba. StorySpan complies with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA). Any dispute arising under these Terms shall be resolved through binding arbitration in Manitoba. You and StorySpan waive any right to a trial by jury or to participate in a class action.
14. Business Transfers
If StorySpan is involved in a merger, acquisition, reorganization, or sale of assets, your information and related agreements may be transferred as part of that transaction, subject to the same commitments set out in these Terms.
15. Modifications to Terms
We may update or modify these Terms at any time. Material changes will be communicated through the Services or by email. Your continued use after such changes constitutes acceptance of the updated Terms.
16. Survival and Entire Agreement
These Terms constitute the entire agreement between you and StorySpan regarding the Services. If any provision is found unenforceable, the remaining provisions remain in effect. Sections relating to ownership, limitation of liability, indemnification, and dispute resolution shall survive termination.

5. Anonymized Data Sharing and Licensing
We may license or share anonymized and de-identified datasets derived from User Content with trusted third parties, including research institutions or non-profit organizations, for scientific or statistical purposes. Such datasets are stripped of personally identifiable information and processed to prevent re-identification. If you wish to opt out of inclusion in anonymized external research datasets, contact hello@storyspan.com.
6. Data Retention and Deletion
We retain information only as long as necessary to fulfill the purposes described in this Policy. Users may request deletion by contacting hello@storyspan.com, and we will process such requests within 60 days. Backup copies may be retained for at least 90 days or longer as required by law or operational necessity.
7. Cookies and Analytics
We use cookies and analytics tools to understand user behavior and enhance functionality. You can manage cookies through your browser settings.
8. Data Security
